By accessing or playing Energy Grid Architect ("the Game"), creating an account, or making a purchase, you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Skyspire Innovations LLC, a California limited liability company ("Company," "we," "us," or "our"). If you do not agree to these Terms in their entirety, you must stop using the Game immediately.
Your continued use of the Game after any update to these Terms constitutes your acceptance of the revised Terms. We recommend checking this page periodically.

We reserve the right to modify, update, or add content to the Game at any time. Free-tier content will remain free for existing users. We do not display advertising of any kind within the Game.
Prices for future purchases may change at any time without notice, but price changes will not affect content you have already purchased. We will provide reasonable advance notice of any pricing changes through the game or our website.
We intend to operate Energy Grid Architect indefinitely, but we cannot guarantee this. In the unlikely event that we permanently discontinue the Game, we commit to:
Temporary outages due to maintenance, third-party service failures, or circumstances beyond our control do not constitute discontinuation and are not subject to refund.
You may create a free account to save your progress and sync it across devices. By creating an account, you confirm that:
Upon account creation, you are assigned an auto-generated display name (for example, "Solar Hawk 247") used on public leaderboards. This name contains no personal information and cannot be used to identify you. Your account session persists on the device where you sign in.
You may request account deletion by contacting us at the email below. We will process deletion requests within 30 days.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, manipulate leaderboard scores, or have been inactive for more than 36 months — without prior notice and without liability to you. We do not currently offer a formal appeals process, but you may contact us at ega.legal.skyspire@gmail.com to dispute a termination in good faith.
All purchases are processed securely by Stripe, a leading global payment processor. Stripe handles all payment processing and regulatory compliance on our behalf. By making a purchase, you also agree to Stripe's Terms of Service. We never receive, store, or process your payment card information — this is handled entirely by Stripe's PCI DSS Level 1 compliant infrastructure.
An account is required before completing any purchase. This ensures your content is permanently tied to your account and accessible on any device you sign into.
Purchases grant you a personal, non-exclusive, non-transferable, revocable license to access the purchased content within the Game. You are purchasing a license to use the content, not the content itself. This license is linked to your account and cannot be transferred, sold, gifted, or shared.
Due to the digital and immediately accessible nature of our content, all sales are generally final once content has been accessed. Exceptions include:

If you have a billing concern, please contact us before initiating a chargeback with your bank or card issuer. We resolve legitimate issues quickly. Initiating an unjustified chargeback may result in permanent account suspension and may be reported to fraud prevention services. Stripe manages all formal payment disputes on our behalf.
All content in Energy Grid Architect — including the game engine, source code, level design, graphics, animations, audio, game mechanics, user interface design, educational content, and all written materials — is the exclusive proprietary property of Skyspire Innovations LLC and is protected under United States and international copyright, trademark, and trade secret law.
The Game's source code and architecture constitute valuable trade secrets of the Company. Unauthorized access to, copying, reproduction, or disclosure of this code is strictly prohibited and may result in civil and criminal liability under the Defend Trade Secrets Act (18 U.S.C. § 1836) and applicable state law.
The Game incorporates certain open-source libraries (including Three.js and Supabase) under their respective open-source licenses. Those licenses do not extend to the proprietary game code built upon them.
You are not granted any license to use our trademarks, service marks, or logos.

Scores are submitted through authenticated sessions and validated against actual gameplay data. We may remove artificially inflated scores at our discretion without prior notice.

Your payment card data is never accessible to us — it is handled exclusively by Stripe's PCI-compliant systems.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION OR ERROR, OR BE FREE FROM VIRUSES OR HARMFUL COMPONENTS. YOUR USE OF THE GAME IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKYSPIRE INNOVATIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY — ARISING FROM YOUR USE OF OR INABILITY TO USE THE GAME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE GAME SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN DOLLARS ($10 USD). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH ANY CLAIM IS BASED.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, internet or infrastructure outages, third-party service failures (including Supabase, Netlify, or Stripe), cyberattacks, government actions, pandemics, or natural disasters. We will make reasonable efforts to restore service as quickly as possible following any such event.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution: Before filing any formal dispute, you agree to contact us at ega.legal.skyspire@gmail.com and attempt to resolve the matter in good faith. We will do the same. If the dispute is not resolved within 30 days, either party may proceed to arbitration as described below.
Binding arbitration: Except as noted below, any dispute, claim, or controversy arising from or relating to these Terms or the Game shall be resolved through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in California.
Arbitration costs: For claims under $10,000 USD, we will pay all AAA filing and arbitration fees. For claims of $10,000 or more, fees are allocated according to AAA Consumer Arbitration Rules.
Mass filing: If 25 or more claimants submit substantially similar arbitration claims against us within a 90-day period, those claims will be subject to AAA's Multiple Case Filing procedures. We agree to work in good faith to streamline resolution of such proceedings.
CLASS ACTION WAIVER: YOU AND SKYSPIRE INNOVATIONS LLC BOTH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS ARBITRATION, OR REPRESENTATIVE ACTION OF ANY KIND. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.
Arbitration opt-out: You may opt out of the arbitration agreement within 30 days of the date you first agree to these Terms. To opt out, send a written notice to ega.legal.skyspire@gmail.com with the subject line "Arbitration Opt-Out," including your name and the email address associated with your account. If you opt out, disputes will be resolved in the state or federal courts located in California, and you and the Company both consent to the personal jurisdiction of those courts.
Exceptions: Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction in California — without first submitting to arbitration — where necessary to prevent irreparable harm, including the unauthorized use or disclosure of intellectual property or trade secrets.

We may update these Terms at any time. We will note the date of the most recent revision at the top of this page. For material changes, we will make reasonable efforts to notify users through the game or by email. Your continued use of the Game after updated Terms are posted constitutes acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Game.
If any provision of these Terms is found unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable — or removed entirely if modification is not possible — while the remaining provisions continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Skyspire Innovations LLC regarding the Game and supersede all prior or contemporaneous agreements on the same subject.
